Attempted murder charge put on hold

— The prosecution of Damen Leroy on attempted murder and arson charges has been suspended while he continues treatment to restore his mental competency, according to court records.

Leroy, 32, of 1053 Mobil St., Lake Geneva, originally was charged early last year on police accusations he stabbed Arthur Johnsen at Johnsen’s Delavan apartment. Records show Leroy then set the apartment on fire, but Johnsen survived.


At the time, Leroy was found incompetent to stand trial. He was committed to a mental health institution under the belief that he could become competent within 12 months, according to court records.


Leroy was recently released to a nearby group home for continued treatment, prompting Walworth County prosecutors to again file the charges.


Unsure of Leroy’s competency, the court ordered another physiological evaluation. That process found that Leroy continued to be incompetent to face the charges, and the court ordered suspension of his prosecution.


Leroy was ordered to appear before Walworth County Judge Robert Kennedy on Nov. 30 for a follow up competency evaluation.
