Appeals court rules in favor of East Troy's plan to build new well

— The village of East Troy cleared another hurdle in its long-running legal battle to build a new high-capacity well.

The District IV Court of Appeals Thursday affirmed a circuit court ruling dismissing the claim that would prevent East Troy from building the well.

The case dates back to 2003, when the village applied for a permit to begin construction of a new well -- well No. 7.

Several Lake Beulah property owners, however, feared the well would lower groundwater levels adjacent to the lake, which would hurt the lake's water quality.

Plaintiffs Kent Haeger, Ron Jarecki, John Sonderegger, and Dale Roble sued the village and the DNR, which issued the permit.

They were joined in their suit by the Eagle Springs Lake Management District and the Phantom Lakes Management District which alleged that Lake Beulah flows into this watershed and, therefore, a reduction in the quality of water in Lake Beulah will have a negative effect on the entire watershed.

They argued the both the permit was invalid, and that the village violated its duty to protect the waters, but the court saw otherwise, and ruled in favor of the village.
